Aylstock, Witkin, Kreis, & Overholtz Secures Significant Jury Verdict Against 3M. A jury in Pensacola, FL has awarded U.S. Army Veteran, Private Brandon Adkins, $8.2 million for tinnitus suffered during active duty while wearing the Combat Arms Earplug sold by 3M.
U.S. District Judge M. Casey Rodgers in Pensacola, Florida on Monday denied 3M's motion for summary judgment in a lawsuit brought by Michelle Blum, who served in the U.S. Army Reserves, National Guard and Army between 1989 and 2009, rejecting the company's arguments that her claims were time-barred.
“It is an admission. It’s like raising a flag to lawyers to say, ‘here’s something to look at it,’” said R. Jason Richards, of Aylstock, Witkin, Kreis & Overholtz in Pensacola, Florida. “Because every time there’s a recall we look at it. Recalls get our attention, and they know it will get our attention.”
